      Only a few days left to apply 

      If you are holding in inventory for sale single-family or duplex house or land which you have improved for residential or commercial purposes since July 1, 2015, you are eligible to have the value of these improvements exempted from local property taxes. This exemption also applies to single-family and duplex houses under construction or land currently being developed.

      But, you must apply for this exemption every January.
       
      In one of NCHBA's most important legislative victories ever, the General Assembly in 2015 exempted from local property tax the increase in value of real property held for sale by a builder or developer to the extent that the increase is attributable to subdivision or other improvement to the property. For more information and details on this law, click on this link.
       
      Don't leave your money on the table! Apply for this exemption.

      Don't Leave Your Money at the TAX OFFICE

      Important Sales Tax Changes Affecting Residential Construction

      The NC Department of Revenue (DOR) has released its E-589CI, Affidavit of Capital Improvement, which generally will be required to substantiate that a contract, or a portion of work to be performed to fulfill a contract, is to be taxed for sales and use tax purposes as a real property contract with respect to a capital improvement for real property. 
       
      NCHBA has prepared a summary explanation of these changes in the sales and use tax applicable to residential construction, amended to include information about the newly released affidavit. Click here to download our summary.
       
      In short, labor charges for new construction and most remodeling activities are not subject to sales tax on labor because they will meet the definition of "capital improvement" pursuant to a "real property contract".
       
      However, except in limited circumstances, the DOR is requiring that E-589CI be provided by a general contractor to a subcontractor to substantiate that the subcontractor's labor is for a "capital improvement". DOR states that failure to provide this form "subjects the transaction to tax as a retail sale of repair, maintenance, and installation services."
       
      Our summary also contains links to directives issued on 11/15/16 by the Department of Revenue about these changes.

      A Letter From The President
      November 11, 2016

      The ink is barely dry on the ballots of our recent general election. This election was a reminder to me of the changes that are constantly taking place in our society, not just politically of course but in the wants and needs of us Americans. Changes in rules, codes, laws, materials and building techniques of course are expected. 

      What is more intriguing to me is the changes that have taken place in the expectations of the public at large regarding housing and just needs for everyday living.  I grew up in a small 2 bedroom, 1 bath,  bungalow with 3 siblings and of course myparents. I do not remember anyone ever complaining about not having enough space, or in sharing the landline telephone (which was a party line, we always had to make sure the line wasn’t in use before dialing). We had a 13” black and white tv with 3 channels, that went off at midnight and resumed broadcast at 6am. I do recall some tiffs about which channel was going to get watched at any given time, but we spent most of our time outside anyway.  A small radio sat on an end table next to the one couch. No one I knew had air conditioning, and at my grandparents farm we still used an outhouse, although I do remember when the inside plumbing was installed. The Frigidaire refrigerator had little metal trays that after frozen in the freezer section that was hanging in the middle of the refrigerator, required a lifting of a little handle to release all of the little ice cubes -cool. Just what was needed for the lemonade on a hot summers day.

      I took notice of something the other night during a visit to one of the four bathrooms in my house. Lights... lights everywhere, the thermostats; which display the 5 day forecast and even current radar, indoor and outdoor temperature andhumidity as well as dutifully controlling the heating and cooling systems. 7 Smoke and CO detectors, each having a green monitor light. The power lights on the BluRay players, satellite boxes and flat screen hd color tvs all displayed various colors to let you know they were there and ready. Then there were the monitor lights on the charging devices which dotted the counters around the home. The kitchen had lights everywhere emitting from each appliance, no danger of losing track of time there. Shadows formed from the light coming in through the windows from the security and landscape lights outdoors. It was easy to navigate around the home without touching a switch, since there were lights everywhere.

      I thought back to the little bungalow where I grew up....one little 7½ watt bulb in the bathroom, and complete darkness.

      We get to create much more than a place to live for our clients these days. They expect to have access to all of the things that make their lives healthier, more enjoyable, more comfortable and more convenient than ever before. I think of my grandchildren who one day will look back and say “ my grandparents had something called a television...."

      Your builders association is here to help keep us more informed and educated of the things that people want and need in their housing. Join us and share in the experiences of the greatest industry in our country, the Building Industry.

      A Quick Phone Call Will Help Make Our Voices Heard

      In just a few days, building inspectors and others eligible to vote will begin the online voting for the ICC code development process (cdpACCESS) for the 2018 editions of the International Residential Code, International Energy Conservation Code, International Fire Code and International Building Code ─ Structural Provisions. The voting period is scheduled to go from November 8th to the 21st.

      You probably don't personally know all of the building inspectors in North Carolina who are eligible to participate (click here to view NC list of validated voters), but you likely know someone who does. With just one call from a builder sharing the importance of the potential impact of the proposals on the code, we believe building inspectors will be more likely to consider our voting positions when they sit down at their computers and vote.

      • Download this Quick Voting List for those code changes that are important to the home building industry and our most important constituency: new home buyers. It's arranged by code type with the most critical votes at the top.
      • Identify builder members that are likely to know code officials on the validated voter list.
      • Encourage them to contact their validated code officials and share our voting list with them.

      WCHS needs judges for Senior Projects

      Judging  will be held on THURSDAY DECEMBER 1, 2016. Judges will start the evening at 5:30pm in the WCHS Cafeteria.

      If you have not previously volunteered to judge these projects, it is a really simple process. 

      Seniors at WCHS are required to complete a cumulative project during their senior English class. The students are required to complete a project, write a paper, create a portfolio, and finally give a presentation to community members. Past projects include: composting, learning to shag, building a boat, and many community service projects. 

      As a judge, you will sit on a panel with 2-3 other judges, review the students' portfolios and then hear and evaluate 3-4 student presentations. No previous experience is necessary.

      Becoming a judge is a wonderful way to connect with others in the community, help our students succeed, and volunteer time and expertise. It is also an excellent way to experience what Senior Projects are all about (especially for parents of future WCHS seniors). You may even learn something!

      This provision, which was inserted into SB 770 (North Carolina Farm Act of 2016) at the request of NCHBA to clarify existing law, excludes certain minor repairs in residential and farm structures from any requirement to obtain a building permit. Specifically excluded is the replacement of windows, doors, exterior siding, or the pickets, railings, stair treads and decking of porches and exterior decks.With respect to plumbing, no permit is required for replacements that do not change size or capacity. 

      STATUS: ENACTED (Session Law 2016-113; these provisions effective 10/01/16). 

      SAVINGS TO MEMBERS: Thousands of dollars in unnecessary permit fees.
